Family sues county govt over alleged land grabbing

A Konoin, Bomet family has sued the County Government of Bomet for allegedly occupying their land.

The family says that the land presently occupied by Itare Water Treatment Plant that supplies water to Bomet and Kericho counties was not acquired procedurally hence demanding for compensation.

The family of the late Kiplangat Soi, through his children, Esther Soi, Andrew Kosgey and others, claimed in their statements before the court that the said land registration no Kericho/Mogogoseik 527 is a property which was registered under the name of their late father which he held in trust .

They claim that their father died in 1972 and they continued living in the said land up to 1978 when the invaders, who were then the national government through the Ministry of Water and Irrigation, forced them out through orders from the area chief Kipkemoi Arap Sang.

They further told the Court that they were relocated to occupy two acres of land next to River Itare and were prohibited from tilling and planting trees.

However, the Bomet County Government, through its lawyers Carolyne Chemutai and Cosms Koech, has denied the family’s statements claiming that the former land owner, the late Kiplangat Soi, was fully compensated for the land by the Ministry of Water and Irrigation hence making the land property of the Kenyan government.

The lawyers further told the court that the government has extensively developed the parcel of land by putting up water treatment plant.

They prayed to court that the plaintiff’s case disclose no cause for action and that the suit should be dismissed with costs against the plaintiff.
