Gatundu South MP Moses Kurias hate speech bond reviewed upwards

The High Court has reviewed the Gatundu South MP Moses Kuria’s bond and bail upwards in a hate speech case facing him.

Justice Luka Kimaru raised the bond from Ksh 5 million to Ksh 10 million and the cash bail from Ksh 1 million to Ksh 3 million.

The review follows an application by the Director of Public Prosecutions (DPP) Keriako Tobiko seeking the cancellation of the earlier bail and bonds awarded to the Gatundu South legislator.

The DPP had argued that Kuria had earlier on contravened directives that he refrains from making comments deemed as inciting or bordering hate speech.

Justice Kimaru warned Kuria not to make any further remarks that may be seen as hate speech failure to which the bond will be cancelled.

Kuria has been given seven days to comply with the review lest he is remanded.

In late November, Kuria was released on bail and bond terms after being in police custody for five days.

Chief magistrate Daniel Ogembo released Kuria on a Ksh 1million cash bail with an alternative bond of Ksh 5 million with surety of similar amount.

Mr Ogembo warned Kuria that this was his last chance, adding that if he repeated such utterances in public it would lead to automatic cancellation of the terms.

The magistrate further asserted that Kuria must respond faster to any court summons regarding the case.

The incitement to violence case will be mentioned on 14th December 2015.
