Governor Wa Iria obtains court order halting his prosecution

Murang’a Governor Mwangi Wa Iria has now obtained orders barring his arrest or prosecution by the Ethics and Anti Corruption Commission (EACC) until a case he filed challenging the move is heard and determined.

Wa Iria argues that the search warrants that formed the basis of the intended prosecution were obtained and executed in violation of his fundamental rights and freedoms.

The constitutional application was filed at the Nyeri Law courts Thursday morning by Mbugua Ng’ang’a and company advocates.

Governor Wa Iria  was to be arraigned in court on Wednesday for allegedly obstructing EACC detectives from searching his home in January 2016.

However, he did not appear in court until Thursday seeking orders to bar his arrest and prosecution.

Wa Iria was arrested Monday afternoon at the Aga Khan Hospital where he had gone to see a patient before being released on a bond of 100,000 shillings after being interrogated at Integrity Center.

In April 2015, Wa Iria  was arrested by the EACC detectives and taken to court for allegedly misleading the Independent Electoral and Boundaries Commission (IEBC) by failing to disclose he was convicted in a criminal case before Makadara Magistrate’s Court.

However, the High Court issued orders restraining the EACC and the Director of Public Prosecutions (DPP) Keriako Tobiko from arresting him in relation to the allegations.

Tobiko had authorised Wa Iria’s prosecution on the grounds that he had provided false information to the IEBC in 2012.

According to the EACC, the Murang’a County boss had been summoned on several occasions to respond to the questions touching on his integrity, but he failed to honour the summons.

The Murang’a Governor is accused of allegedly deceiving and knowingly misleading the anti-graft body, when he filled the integrity form ahead of the 2013 General Election.
