75 Years In Jail For Dad For Infecting Daughter With AIDS

During the ruling made on Thursday in the Children’s court, David Chege was found guilty of incest and deliberately transmitting HIV/AIDS to his 12-year-old daughter on January 12th, 2013 at their Njoro home.

The court ruled that Waweru will serve 25 years for indecent act and 50 more years for deliberately infecting his daughter with HIV/AIDS.

Senior Resident Magistrate Judicaster Nthuku said that the indecent act by the accused has change the minor’s life.

The court heard that in January 12th, 2013, Waweru came home drunk and found his daughter and her three siblings sleeping and ordered her to move to a separate room. The minor obeyed and moved to a separate room oblivious of her father’s intentions.

DENIED CHARGES

The class five pupil told the court that her father moved to the separate room where she was and warned her not to scream before he sexually assaulted her.

“I had to wait till morning to tell my grandmother because my mother was in Narok then. When I told her, she reported the matter to the Mau Narok police station. When my mother came she took me to hospital,” she told the court.

The accused, however, denied the charges.

“When I did the examinations, the accused tested HIV positive. The minor's private parts had bruises, though the hymen was intact on examination,” the clinical officer who examined the girl told the court.NO EVIDENCE

“The accused deliberately committed the indecent act when he knew he was HIV positive, the fact he admitted to the doctor during the examination.”

“The beastly act had been proven beyond reasonable doubt by the prosecution,” said the Magistrate.

She added that there was sexual activity but there was no evidence of penetration since the minor's hymen was found intact according to the P3 form produced in court.
