At least 80% of politicians would be unfit to hold office should Chapter Six of the Constitution of Kenya 2010 on Leadership and Integrity be implemented fully.

Former Chief Justice, Dr Willy Mutunga, said that most of Kenyan leaders do not meet the Constitutional requirement and should the chapter be effected, they will be rendered unqualified.

A report by Freedom House, an organization championing for democracy, assessed the country’s progress towards improving government’s accountability, promoting civic liberty and human rights.

The report quotes Dr Mutunga as saying that to deal with the corruption menace, the government should begin with devolved units themselves.

“We are not paying attention to the grassroots consciousness that’s growing around the equitable distribution of resources. We might even have a situation where fighting graft starts at the grassroot,” stated Mutunga.

According to the former CJ, the first people who should be prosecuted are the leaders in the counties.

“In terms of corruption, and this is my dream, the first people to be hung should be Governors and MCAs by the people around the grassroot themselves because they are very aware about the distribution of resources,” said Mutunga.

Mutunga also touched on the Judiciary saying one cannot subvert the Judiciary’s independence.

“The Civil Society interests in this country are very powerful. They can affect Judicial independence, cartels as you know, communities, friends, family. We must as Kenyans emphasize on transformative optimism.”
