Activist wants Millie Odhiambo compelled to apologize to Uhuru

An activist has sued Mbita Member of Parliament Millie Odhiambo Mabona over her alleged remarks made in Parliament against the President.

Philip Njuguna Waruth wants the MP compelled to issue an apology to the Kenyan people in a manner and terms approved by the court though mass media over the alleged remarks.

Through lawyer Harrison Kinyanjui, the activist argues that the Mbita MP is bound to uphold, protect and defend the Constitution but she has not done so.

“Her utterances are in contravention of the constitution as they constitute denigrating the Presidency. The words uttered have by extension violated the Parliamentary privilege and immunity and such is not available to her defence,” said Njuguna in court documents.

It is his argument that the court ought to protect the right of the Kenyan people to a presidency held and carried with dignity as enjoined in the Constitution.

He argues that Millie partook the oath of Member of National Assembly and thus bound herself to obey, respect and defend the Constitution.

He claims that the MP’s words implied that the Deputy President and the Cabinet were all appointed by an uncouth person, a bumpkin and therefore leading Kenya in similar fashion.

It is his argument that all the foreigners reading the true implication of the Millie’s word thinks lowly of Kenyans generally as a nation of uncouth and heathen persons.

Njuguna has sued the MP, the Attorney General and the Speaker of National Assembly.

He wants the court to declare that the utterances made by the Mbita MP are in violation of the constitution and constitutes a denigration of the Presidency.

“Her words constitutes a violation of oath of office as a Member of the National Assembly and is contravention of the ethical requirement mandated to her as an MP,” he stated.

The activist further wants an order restraining the MP from further uttering words that would denigrate the presidency.
