Alfred Keter to know his fate in July

Alfred Keter, who filed an appeal over the Nandi Hills election petition ruling, will know his fate in the next two months.
Keter had sought intervention of the Court of Appeal seeking that an earlier ruling by Justice Kanyi Kimondo of the Eldoret High Court to nullify his election, be set aside.

On Friday, Judges Erastus Githinji, Fatuma Sijale and Anna Okwengu directed that the appeal be determined on July 11.

Keter’s lawyer Otiende Amollo had argued that reasons that led to the nullification of his client’s victory, that he campaigned beyond stipulated time, were untrue.

According to him, the matter was not within the hearing jurisdiction of the petition.

Lawyer Amos Magut, who represented the petitioner Benard Kitur, however insisted that the main issue for the case is campaigning beyond stipulated time.

The High Court in Eldoret nullified Keter’s win in March this year citing election malpractices.

In his verdict, Justice Kimondo said there was evidence the legislator conducted illegal campaigns outside the stipulated time.

In the August poll, the Independent Electoral and Boundaries Commission announced Keter as the winner with 28,923 votes against 13,872 garnered by his main rival Kitur.
