Anti Graft Secretary Accused of Drawing Two Salaries

This is according to an investigation report by the office of the Ombudsman which indicates that Mubeya signed two separate contracts to facilitate an irregular higher pay.

The Commission on Administration of Justice (CAJ) has been scrutinizing Mubea’s employment contract, and has discovered a major anomaly. 

Mubea’s employer, the Ethics and Anti-Corruption Commission apparently drew similar contracts for him and colleague Edward Kenga Karisa who is also on grade 2 with a starting basic salary of Ksh 400,000 to 500,000 and an annual increment of 5%. 

They were apparently advised then that the contracts were interim pending advice from the Salaries and Remuneration Commission (SRC). 

But Mubea told the Ombudsman's investigators that he did not sign that contract, having declined the offer because he found the salary to be low.

 

Signed two separate contracts for same position

Instead he submitted a copy of his current contract of employment in which he negotiated for a fixed salary of Ksh 500,000 and allowances amounting to Ksh 280,000. His gross salary would add up to Ksh 780,000 per month and this is what he has been taking home since. The contract was dated 16th Jan 2013.

CAJ is, however, in possession of a copy of another contract document dated 15th January 2013 indicating Mubea’s starting basic salary as Ksh 400,000 and an annual increment of 5%, which he apparently signed on the 16th January, 2013.

It is apparent, according to the investigation report, that this was the actual contract that should be in force.

Eleven months after his employment, SRC presented EACC, with a salary structure. It recommended a gross monthly remuneration of Ksh 400,000 up to Ksh 550,000 for the Deputy Commission Secretary of EACC Grade 2 where Mubea falls.

The office of the Ombudsman did its calculations and found that Mubea had earned 1.2 million shillings more than he should have and recommends that he refunds the commission and reverts to the Ksh 400,000 monthly salary.

In his defence, however, Mubeya draws attention to a letter from the Salaries and Remuneration Commission’s letter advising EACC to retain the existing staff salary structure.
