Arrest warrant issued for officer holding passport of man conned Ksh.150M

A Nairobi court has issued a warrant of arrest against a police officer accused of withholding a passport belonging to a foreigner who was allegedly defrauded Ksh.150 million in Kenya.

Principal Magistrate Hellen Onkwani issued the warrant after the officer, Mike Muya, attached to the Directorate of Criminal Investigations (DCI) failed to appear in court to explain why he is holding the passport.

The magistrate ordered that the warrant be effected by the Nairobi DCI commander Bernard Nyakwaka.

Damir says his travel documents were confiscated by detectives during investigation into a complaint he filed after he was allegedly duped and defrauded Ksh.150 million by two Kenyans claiming they could sell him coffee and artifacts. The two Kenyans have since been charged in court.

On Monday, he moved to the Chief Magistrate’s Court in Nairobi saying he was willing to abide by any conditions the court may issue for the release of his documents.

He argued that as a complainant in the case, the confiscation of his passport without a court order or any explanation is unlawful, inhuman and degrading treatment.

The matter will be mentioned on Friday, July 19 to asses whether the officer has been arrested and the passport deposited before court.
