Bishop Wanjiru freed after spending a night in police custody

High Court has released Bishop Margaret Wanjiru on a Ksh 100,000 cash bail after overturning 5-day detention handed by lower court over destruction of property charges.

This was after the Nairobi Gubernatorial aspirant filed an application seeking a review of court decision to deny her bond and order that her bond terms be effected on Tuesday next week.

Through Lawyer Kennedy Ochieng, Wanjiru told Justice Ngenye Macharia that the orders issued by the trial court infringes on her rights as enshrined in the Constitution and are detrimental to her right to fair trial.

Ochieng further argued that the said orders also set a dangerous precedent of a court not only granting orders that are not sought for but also allows detention without trial ostensibly to carry out investigations.

On Thursday, the court had ordered that she be detained for five more days after which she will be required to pay Ksh 500,000 as cash bail plus two Kenyan Sureties after the investigators asked the court to confine her for more days citing witness interference.

Bishop Wanjiru who was detained at Kileleshwa Police Station is accused of, jointly with others not before court, of unlawfully destroying four ballot boxes and assorted ballot papers valued at 30,000 shillings, disrupting the voting process and creating disturbance.
