Blow to ODM chair John Mbadi as Court nullifies his nomination

The Political Parties Disputes Tribunal on Friday, May 5 declared the decision by ODM party to award Suba Member of Parliament, John Mbadi, the nomination certificate as null and void.

The three bench Tribunal also ordered the National Elections Board to carry out fresh nominations in seven polling stations in Suba South.

The Nairobi-based Tribunal noted that ODM did not have consent from National Elections Board that cancelled the results because of irregularities and ordered fresh nominations before ODM party referred to the party laws to nominate a candidate of their choice.

The bench had earlier ordered that the election be done within 48 hours but the ODM party advocate and that of Mbadi requested the bench to allow the re-election within 72 hours to enable them prepare adequately for the exercise, an application that was granted.

This comes after Suba ODM aspirant, Caroli Omondi, filed a complaint before the Tribunal saying that ODM violated his political rights to unfairly award the certificate to Mbadi to fly ODM flag in the forthcoming General Election.

Meanwhile, Prof Peter Anyang’ Nyong’o will know his fate as the Kisumu gubernatorial nominee Saturday, May 6, 2017, when the Tribunal will deliver a ruling in a case filed by two people who claim ODM membership.

Hezron Opiyo and John Oketch argued that the party gave Nyong’o a nomination certificate against the law even when the results were contested.

Nyong’o, in his defence through lawyer July Soweto, however, argued that he was nominated by the party after the party tribunal nullified the nominations.

ODM on its part argued that they used the 2017 party rules which gives them power to nominate under special circumstances, an argument disputed on account that the rules have not yet been operationalized.
