Blow to Ranguma as court declares Nyong’o Kisumu gubernatorial primaries winner

Kisumu Senator, Prof Anyang’ Nyong’o, will now fly the Orange Democratic Movement (ODM) flag for the Kisumu gubernatorial seat in the forth coming General Election.

This is after the Political Parties Disputes Tribunal in Nairobi dismissed a complaint filed by two men who claimed to be ODM members and sort to have the nomination certificate awarded to Prof Nyong’o withdrawn and his nomination nullified.

The three-bench Tribunal cited lack of jurisdiction to hear and determine the complaint on the basis that the case was not properly filed before them.

Nyong’o, through his advocate and the ODM party advocates, had raised several preliminary objections why the bench should not hear and determine the matter.

The respondents had argued that the complainants had not presented in court evidence to show that indeed they belonged to the party, further the bench heard that the incumbent Governor Jack Ranguma and other external forces were camouflaging in the two men with the complaint.

They argued that the real aggrieved people could have appeared in person and not inform of busybodies send indirectly on their behalf.

As such, the Tribunal found out that the men are not aggrieved in any way because they were never contestants in the just concluded party nominations hence dismissal of the case.

The men complained of unfairness and irregularities in the nominations that lead Nyong’o to be pronounced as the winner.
