Board sacks eight magistrates, reinstates 20 others

The Judges and Magistrates Vetting Board has sacked eight Magistrates after failing the vetting exercise.

The eight include; Teresiah Ngugi Njeri, Timothy Odiwuor Okello, Wilson Nkunja Kaberia, Ezra Odondi Awino, Samwel Gacheru, Bernard James Ndenda, Wilkinson Nyaga Njage and Jacinta Kwena Dibondo.

The board led by the chair Sharad Rao has at the same time reinstated 20 judges and magistrates it had earlier found unsuitable to hold office.

Among those who were considered “suitable to continue to serve” include; Justice Grace Nzioka Lidembu, Mogute Stephen Onsiero, Layila Dolphina Alego, Oganyo Roselylne Akinyi, Samuel Mokua Mogaka, Sindandi Calestous Nambafu, Thomas Thyaka Nzioki, Mutua Philip Wambua, Atambo Stella Bonaberi, Tito Maoga Gesora, Mutai Lucy Kathure, Teresiah Mumbua Matheka, Jesse Njagi Nyaga, Ben Mwai Mararo, Mutoka Rosemelle Anyango, Mmasi Grace Ayuma, William Chepseba Kipkemei, Bildad Ochieng, Beatrice Mosiria Nyambune and Lily Nafula Monica.

While releasing its verdict, the board’s chair Sharad Rao noted that the decision to reverse their earlier ruling was based on reviews done on the cases after the affected judges appealed for a review of the board’s earlier decision.

Rao further noted that Parliament had extended the term of the board for three months in which the board will be drafting its final report and concluding pending cases in court among other things.

Rao further noted that the purpose and objective of the vetting was to restore confidence in the Judiciary to which he said had been to a great extent achieved.

The board consisted of Roseline Odede serving as the board’s vice chair, Justus Munyithya, Prof. Ngotho wa Kariuki, Abdirashid Abdulahi, Hon. Lady Justice Alice Mpagi-Bahigeine, Meuledi Iseme and Reuben Chirchir serving as the Board’s secretary and CEO.

The Judges and Magistrates Vetting Board was established by the Government of Kenya as a result of the Vetting of Judges and Magistrates Act, 2011 which was passed by parliament to create the necessary institutional framework and guidelines for the vetting of Judges and Magistrates.
