Bomet in no hurry to swear in DG after Laboso demise: Speaker

  • According to Article 182 (2) of the Constitution, the office of the County Governor becomes vacant if the holder either dies, resigns in writing, ceases to be eligible to hold the Governor post or is convicted of a criminal offence punishable by imprisonment of at least 12 months.
  •   If such a vacancy occurs in the office of governor, the deputy governor assumes the office for the remainder of the term or until the next election held under Article 180 (1).
  •   In the event the deputy governor is unable to act, the Speaker can act as Governor.

The Speaker of the Bomet County Assembly has said they are not in a hurry to swear in the deputy governor Hilary Barchok following the death of Dr. Joyce Laboso.

Dr. Shadrack Rotich maintained that there was no power vacuum at the moment that would warrant the swearing in and according to him, no law stating that the ceremony should be done within a given period.

“We have consulted widely, we are not about to engage in that ceremony, we are now focused on mourning and the burial program,” he said.

If such a vacancy occurs in the office of governor, the Deputy Governor assumes the office for the remainder of the term or until the next election held under Article 180 (1).

In the event the Deputy Governor is unable to act, the Speaker can act as Governor.

In case the Speaker assumes office of the governor in acting capacity, the law then requires that a new election be held within 60 days to elect a new county governor.

The Bomet County Assembly has also adjourned its sittings to enable House members and staff to attend the memorial service and burial.

The family of the late Laboso on Tuesday announced that the Bomet Governor will be buried in Kisumu County on Saturday.
