Bonchari MP John Oroo survives appeal case, to serve full term

Bonchari MP John Oroo Oyioka will serve his full five-year term after a Kisumu court dismissed an appeal challenging his election.

The Court of Appeal threw out the case filed by former MP John Zebedeo Opore for lack merit.

Appeal Judge Kathurima M’inoti upheld the decision of the Kisii High Court Judge Anthony Ngungu.

While delivering the judgment, Justice Kathurima said the appellant did not provide sufficient evidence proving his allegations of electoral malpractices as contained in the appeal.

He added that the appellant failed to prove accusations of violence, voter bribery among other claims.

“The quest for further scrutiny of votes and recount was a mere fishing expedition for evidence,” he quipped.

Justice Kathurima further noted that a scrutiny and recount of the votes confirmed the credibility of the election.

In his ruling, he affirmed that the magnitude of the errors alleged were negligible and could not overturn the election result.

Bonchari MP Oyioka welcomed the court’s decision saying that the frequent court battles were at the expense of development initiatives in the constituency.
