A psychiatrist report on Thursday indicated that a 13-year old boy accused of sodomising four boys aged between five and seven years at Kiriari village, Embu is not mentally fit to stand trial.

A medical report from Embu Level V Hospital produced in court and signed by Dr. Thuo JN, concluded that with the minor’s state of mind, he won’t be able to follow court proceedings.

The assessment report follows a court order by Embu Chief magistrate Maxwell Gicheru after the boy was arraigned in court over the crime.

The boy was charged with sodomy and also faced alternative charges of indecent act with the boys in September.

The boy’s advocate has since applied for the dismissal of the cases saying his client is not of sound mind.

But the prosecution opposed the application urging the court to move the case to trial since the psychiatrist had not indicated the reason why the accused could not stand trial.

The court ordered that that the boy be released on a Ksh.100,000 bond. The case will be heard on January 23, 2019.
