Businessman found with plastic bags charged

A businessman has been fined Ksh.100,000 by a Kibera court after he confessed to being in possession of 15 bales of plastic bags.

Bernard Kuria, the director of PINCHEN Ltd appeared before Kibera chief Magistrate Joyce Gandani for the presentation of facts by the prosecution after pleading guilty to the charges on Tuesday.

He pleaded guilty to allegations of being found with 15 bales of plastic bags at his business premises in Industrial Area, Nairobi on December 4.

The 15 bales of plastic bags were also presented before the court as exhibits. The National Environment Management Agency (NEMA) will dispose them off.

In mitigation, Kuria asked the court for leniency telling the magistrate that he is a first time offender.

In her ruling, Gandani said that she had considered the accused persons mitigation and thereby ordered him to pay a fine of Ksh.100,000 in default or serve a three month jail term.

The government issued a ban on plastic bags in August this year promising to take legal action against any Kenyan who will be found manufacturing or using the said bags which is now illegal.
