Cameroonian in court to stop his deportation from Kenya

A Cameroonian man who was deported from Kenya last year but managed to find his way back has moved to court challenging the government’s new directive for his deportation.

Through his lawyer, Mr. Doctta Peter Longa, who is in police custody, claims that he is being tortured and discriminated against, adding that he was not allowed to arrange for the management of his company, its assets or relations.

“I have the legitimate expectation that I would be protected by the law and have full benefit of the law while in Kenya and not discriminated against,” claims Mr. Longa on Wednesday.

He told the court that there has been a continued infringement of his fundamental rights and freedoms as he has continuously been kept under police custody despite the fact that he is out on bail terms.

“There is continued disobedience of the court orders by the respondents particularly the DCI George Kinoti and County Criminal Investigations Officer Nicholas Kamwende who have continued to detain him at their pleasure despite there being orders restraining them from detaining him,” read the court documents.

He wants the government compelled to release him from custody unconditionally, adding that he has been illegally and unlawfully detained by the respondents for one month now.

Similarly, he wants the respondents prohibited from arresting or compromising his liberty.

He claims that there are conservatory orders from the High Court restraining the government from removing or deporting him from Kenya.

According to Mr. Logga, he lawfully and legally first came to Kenya in 2015 to do business. He says he has a company registered in the name of Longa Investments which owns properties including land, motor vehicles and other movables.

He avers that the late Interior CS Joseph Nkaisery in 2017 made an order that declared him a prohibited person and ordered that he be deported and that he (Longa) considers the order as unreasonable, irrational, oppressive and illegal.

Mr. Longa claims that the statement made by the late CS has greatly harmed his reputation.
