Case adjournments still a major challenge  CJ Maraga

Chief Justice David Maraga now says that adjournments of court cases remains a major challenge even as the judiciary continues to focus in clearing the backlog of cases in a bid to enhance performance.

Maraga who is also the president of the Supreme Court however noted that reasons for adjournments are usually internal, whilst others are external.

“For instance, an analysis of High Court monthly statistics, for the period July 2017 to March 2018 shows that the major reasons for adjournments of cases were “Parties not present”, “Parties not ready”, “Court not sitting”,“Advocates not present,” and “Advocates not ready”. This accounts for over 60 % of the reasons for adjournment,” said Maraga.

While acknowledging an improvement in delivery, Justice Maraga called on judges and magistrates to work together for the benefit of the common mwananchi.

The CJ, who was speaking during the launch of performance management and evaluation understandings evaluation report 2016/2017, also noted that the number of resolved cases increased by 58 per cent in 2016/17 compared to 2015/16.

During the launch, Malindi Court of Appeal was listed as the best performing Court of Appeal while Machakos High Court presided by Pauline Nyamweya was named the best performing High Court.
