Case against dissolution of NGO board to be heard in January

 

A case contesting the decision by Devolution CS Mwangi Kiunjuri to dissolve the NGO Board and send Director Fazul Mohamed on compulsory leave will be heard in January 2017.

This is after judge George Odunga heard that parties and the CS are in talks in a bid to solve the matter amicably out of court.

The court was also told that the CS is yet to respond to the matter since the NGO board has been moved from the Devolution to the Interior Ministry.

Fazul has challenged Kiunjuri’s move insisting that the power to dissolve the board solely lies with the president.

The CS’s action was necessitated by claims that the latter has fake academic qualifications.

Fazul argues that the CS breached the Constitution, specifically Section 7(3) of the State Corporation Act.

“The decision to send Fazul on compulsory leave is illegal, unlawful and null and void,” the petitioners argued.

The petitioners argued that CS Kiunjuri acted in bad faith by making the unilateral decision.

The case will be mentioned on January 30, 2017.
