Case against Health ministry over CT scanner tender withdrawn

A petitioner challenging tendering afresh of 37 CT scanners by the Ministry of Health now wants the case withdrawn.

In a notice of withdrawal filed at Milimani Law Courts dated 7th September, Anthony Otiende requests the withdrawal of both the petition and the application dated 29th August, 2018.

Otiende has however, not stated the reasons as to why he wants the case withdrawn.

Moreover, the respondents listed in the case have not filed their responses to the case as earlier directed by Justice Chacha Mwita.

In the August petition, Otiende alleged that the scanners had already been budgeted for in the acquisition of Medical Equipment Services (MES) at a cost of Ksh.4.5 billion.

He noted that the country stands to lose billions arising from the alleged double tendering scandal.

The city lawyer, claimed that Ministry of Health issued a fresh tender for the procurement of the scanners despite the existing allocation in the budget.

He further claimed that the cost of the machines had been inflated four times.

Otiende accused the ministry of purchasing each scanner at a cost of Ksh.227 million yet the current market value for such equipment is estimated at Ksh.40-45 million per machine.

According to him, the Health Ministry had deliberately and contemptuously violated the law which provides that procurement of public goods and services must be in accordance with a system that is fair, equitable and transparent.

The matter is expected to be mentioned on November 5, 2018.
