Case against Humphrey Kariuki and co-accused set for April 28-30

The court has finally set firm dates for the hearing of the case against businessman Humphrey Kariuki and his co-accused after several delays in starting the trial.

The case is now set for April 28, 29 and 30 this year.

Kariuki through his lawyers Cecil Miller and Kioko Kilukumi accused the prosecution of failing to provide evidence for over 18 months.

This despite a highly publicized raid at his Thika-based Africa Spirits Limited factory.

On Tuesday, Kariuki termed the decision to set dates for the hearing as long overdue.

“We are pleased with the decision by the court today to agree with our request to set firm dates for a hearing… this is a clear message to the Prosecution, which has failed to produce evidence for 18 months now, that it can no longer continue to delay and try to deny me justice,”

He argued that the allegations throughout the farcical process, are entirely unfounded as he is a law-abiding citizen.

“Today’s decision highlights that our court system remains independent and strong. This is a signal to African entrepreneurs and investors – you are protected by the law and that Kenya is open for business. We must encourage African investment; not discourage it.”

At the same time, the court has ruled it will visit the Africa Spirits Limited’s liquor factory for purposes of collecting evidence.

Trial magistrate Martha Mutuku allowed the application saying the court needs to familiarize with the scene in which the accused persons claim the factory has been vandalized since it was closed on January 31, 2019.

The site visit will take place on April 28, 29 and 30.
