Case against man accused of assaulting Kenyan politician fails to proceed

A case in which a Somali businessman is accused of assaulting and causing grievous harm to a Kenyan politician has failed to proceed for the second time.
The parties advocates, who appeared before Makadara Magistrate Eunice Kimaiyo for defense hearing on Tuesday, could not proceed as the court was informed that the accused — Jamal Mohammed — was unwell and he could not make it to court.
“We request the court to allow an adjournment because the accused has been taken ill and could not make it to court,” advocate Abdirahman Warsame told the magistrate.
The prosecution objected the application for adjournment noting that it was the second time that the defense was seeking for an adjournment in the matter.
The court, however, allowed the application for adjournment and set the matter for a mention on October 16, 2018.
On July 13, 2018, the accused had also requested for another adjournment claiming that he was not ready to present his evidence to court.
The accused, who was placed on his defense on July 2, 2018 after he was declared to have a case to answer in relation to the charges he faced, had indicated that he was going to call five witnesses who would testify in his favour.
Jamal, who is also an American citizen, is charged with assaulting and causing grievous harm to politician Hussein Mohammed, who vied for the Wajir South parliamentary seat in the August 2017 General Election but lost.
He is alleged to have committed the offence on September 17 outside a mosque at 7th street in Eastleigh, Nairobi, leaving Hussein with serious injuries on the left leg.
Jamal, who was also charged of being in Kenya illegally, denied all the charges and is out on a Kenyan surety bond of Ksh.300, 000.
