Charles Nyachae rules out heading CIC beyond December

The Commission for the Implementation of the Constitution (CIC) chair Charles Nyachae has ruled out heading the commission beyond the December 29th, 2015 expiry date.

Nyachae said he intends to step aside after the expiry period though calling on the Senate and National Assembly to put in place mechanisms that will keep the commission in place beyond the December date.

Speaking when he appeared before the Senate Legal Affairs Committee, Nyachae said there is need to extend the commission’s mandate, though with new members.

He noted that there is a lot that needs to be done in the implementation of the constitution adding that the country still needs the guidance of CIC.

Nyachae urged Parliament to put in place transitional framework to oversee the implementation of the remaining sections of the Constitution.

Committee chair Amos Wako concurred with Nyachae saying several legislations have not been enacted necessitating the need to extend the commission’s lifeline by a maximum of 2 years.

“Just like parliament which extending the time required to pass bills, CIC needs to be given more time to ensure the remaining sections of the Constitution are implemented,” said Wako.

The commission’s term is set to end on December 29th 2015 after the expiry of their five year mandate as stipulated in the Constitution.

CIC is mandated to monitor, facilitate and oversee the development of legislation and administrative procedures required to implement the Constitution, according to Chapter 18 on the Transitional and Consequential Provision.

The commission is also responsible for the implementation of the Constitution, highlighting impediments to that effect and ensuring the letter and spirit of the Constitution is respected.

According the Constitution, the commission “shall stand dissolved five years after it is established or at the full implementation of the Constitution as determined by Parliament, though the National Assembly may, by resolution extend its life”.
