CID boss Ndegwa Muhoro to sue city lawyer Ahmednassir Abdullahi for libel

The Director of Criminal Investigations (DCI) Ndegwa Muhoro has threatened to sue city lawyer Ahmednassir Abdullahi over allegations that he (Muhoro) was paid to drop investigations into the actions of former CBK Governor Nahashon Nyagah who is accused of grabbing part of Tatu City land.

Muhoro has denied the allegations saying the file was forwarded to the Director of Public Prosecutions for legal advice saying he has no control over the office of the DPP.

Muhoro further wants Ahmednassir, together with several media houses, to apologise and cease publishing any further remarks injurious to him failure to which he will move to court.

In May last year, Tatu City’s American and international owners filed a lawsuit against former Central Bank Governor Nahashon Nyagah, accusing him of defrauding the project of land worth 9 billion shillings.

According to documents filed in court, Nyagah illegally transferred land owned by an American-led group of investors to his sister-in-law, cousin, his cook’s daughter and members of his church congregation.

The land referred to in the lawsuit as neighbours Tatu City and is part of the wider Kofinaf Coffee estate.

In August 2015, the majority shareholders in the Tatu City project opposed an application by their minority counterparts seeking to reinstate civil suits filed against the multi billion shillings project’s directors.

Senior Counsel Ahmednassir Abdullahi told a trial court that Nyagah and industrialist Vimal Shah, who are minority shareholders, did not seek authority from the parent company to lodge the  proceedings.

The Senior Counsel said that Tatu City and Kofinaf Limited – the majority shareholders, applied formally to have the protracted suits withdrawn.

Ahmednassir further said that the Deputy Registrar of the High Court endorsed the withdrawal, adding that there is no prejudice suffered by the minority shareholders by having the suits withdrawn.

Nyagah and Vimal, who were represented by former Judge Richard Otieno Kwach and Nelson Havi, told Justice Charles Kariuki that the withdrawal of the suit was unlawful.

The two have opposed their majority partners’ decision on the basis that the four-year legal wrangles cannot be resolved without the participation of the parent companies.
