City Judge ‘leaves justice to God’, closes murder case

The inquest into the death of a Nairobi businessman’s driver who was burnt alive in his car has been closed.

This is after the court ruled that the inquest is inconclusive due to lack of proper investigations and phone data records among others.

The Director of Public Prosecutions (DPP) had ordered the inquest after James Kiarie was burnt in Nairobi businessman Ashok Shah’s car in May 2010.

The court was told that three men broke the car’s windows, poured petrol and set it on fire.

In his ruling, Makadara Law Court Senior Magistrate, William Oketch, ruled that the inquiry into who killed the said driver failed to point out the killers.

However, the court noted that the killers will not escape God’s justice.

Further, the court directed the inquest file be forwarded to the Director of Public Prosecution and be closed.

The allegations and assertions that Ashok Shah’s former business partner, Hiten Raja, was involved in the attack was dismissed.
