Civil servants eyeing political posts to remain in office after losing nominations

Public officers planning to vie for elective seats in the August election can now breathe easy after a Kericho Court ruled that they can remain in office if they lose in party nominations.

This is after Employment and Labour Relations Court Judge, Njagi Marete, declared Section 43 (5) of the Elections Act of 2011 unconstitutional, unjustifiable, unreasonable, unfair and unacceptable.

The ruling quashes an order by Head of Public Service, Joseph Kinyua, in a letter dated December 1, 2016, which required all public servants to have vacated office on or before the 7th of last month.

The Judge explains that public officers can only leave office to fully participate in the electoral process on nomination by their respective political parties or on conclusion of the nomination process.
