CJ Maraga puts rogue lawyers on notice

Chief Justice David Maraga has put lawyers who delay cases in court on notice saying they should brace for disappointment as the judiciary implements new measures.

The chief justice noted that the parties involved in some “dead file” cases do want the cases to end, adding that the cases become statistics and the judiciary is blamed for them.

“I give a pledge to the nation that all cases that have taken five years and above will be cleared,” he said.

“For one reason or the other the parties [who filed the cases] don’t want the cases to end but the public doesn’t know that so all the blame is coming to us. We are putting our foot down and we’re going to disappoint some lawyers,” he said.

The CJ was speaking in Nakuru when he paid a courtesy call to Governor Kinuthia Mbugua.

He added that more than three quarters of the cases that have been in the courts for a long time were filed by parties who did not have a definite objective of seeking justice.

He stated that the judiciary would build courts in Njoro and Subukia in a bid to enhance the access of justice by the mwananchi at the grassroots.

The initiative is also expected to ease the pressure of handling anticipated election petitions from one central place.

Speaking at the same time, Nakuru County Governor Kinuthia Mbugua called on CJ Maraga to speed up several land cases lodged in Nakuru County that he says had dragged on for several years.
