CJ Maraga to push for admission of CCTV footage as evidence

Chief Justice David Maraga has said they will push for the admission of CCTV footage as evidence for faster delivery of justice.

Speaking during the 20th sitting of the National Council on Administration of Justice, CJ Maraga also supported calls for the Judiciary to adopt plea bargains as one of the methods of concluding court cases.

“We need to have an open and honest discussion on how to deal with the issues in the commercial justice system and criminal justice sector relating to corruption,” said Maraga.

In the sitting that brings together State and non-State actors in the justice sector, Maraga was also on a fire fighting mission.

This comes in the wake of attacks against the Judiciary which has been accused of being the weak link in the war against graft.

He admitted that perennial delays in hearing and determination of cases were negatively impacting investor confidence.

Maraga at the same time dismissed claims that his recent transfer of five judges was as a result of pressure from the executive.

“Why didn’t they complain when I moved the others? Why these ones? Do they know I am transferring more next week?” he posed.

The meeting resolved among other things to push for changes in the law to allow the use of evidence from non-traditional sources including CCTV.

In order to expedite cases before the courts, plea bargains will be integrated.

”In the case of NYS 2 and the banks, we will listen to them, we don’t want to shut down these institutions,” said Director of Public Prosecution Noordin Haji.
