Commission report shows Makueni County headed for dissolution

The Commission of Inquiry into whether Makueni County should be dissolved has recommended for suspension of the county after it completed its investigations.

The Mohamed Nyaoga-led commission presented its report to President Uhuru Kenyatta at State House, Mombasa

President Kenyatta now has seven days to submit a report to Senate that will be tasked with the responsibility of recommending further action.

The vicious power struggles pitting Governor Kivutha Kibwana and Members of the County Assembly have seen operations in the county paralyzed.

The report has recommended suspension of the county, and subsequently its dissolution after at least 94% of the residents who appeared before the commission recommended dissolution as the way forward.

The commission also established cases of wastage and misappropriation of devolved funds and other county resources.

With the imminent dissolution of Makueni County, Governor Kibwana, through a facebook post, said his government was ready for the Nyaoga commission verdict and would respect it, since it reflected the wishes of the county residents.

Article 192 of the Constitution of Kenya 2010 and section 132 of the County Governments Act outlines the process of suspension and dissolution of a county.

Within seven days of receiving the Nyaoga commission report, President Kenyatta will submit it to the Senate to take a vote to either suspend the county or reject the recommendation.

The county can only stand suspended if at least 24 out of 47 elected Senators vote in favour of the recommendation. If the county is suspended, Governor Kibwana, his deputy, the executive and Members of the County Assembly will be barred from transacting county business but will be entitled to half pay for 90 days.

An interim County Management Board shall be appointed to take charge. If the suspension is not lifted within 90, then the Governor, his deputy and Members of the County Assembly will lose their jobs, and a fresh election held. All nominated MCAs will also lose their jobs.

In apparent anticipation of a fresh gubernatorial poll, Governor Kibwana, who was elected on a Mazingira party ticket, has been aligning himself with former Vice President Kalonzo Musyoka’s Wiper Party.

Musyoka is expected in Makueni on Friday, to spearhead a voter registration campaign.
