Company in NHIF scandal wants DPP, DCI barred from interfering with their servers

A technology company charged in the National Hospital Insurance Fund (NHIF) fraud case has now filed an application seeking orders restraining the Director of Public Prosecutions (DPP) and the Director of Criminal Investigations (DCI) from interfering with its servers at the State corporation.

Web Tribe Limited, through its director Danson Muchemi, on Wednesday argued that the company will be prejudiced if the DPP and DCI are not restrained from interfering with their web servers installed at NHIF premises.

According to Mr. Muchemi, the DCI had already conducted a search on the petitioner’s (JamboPay) offices and seized documents in respect to the contract for provision of integrated revenue collection services (Tender No. NHIF/001/2017-2018).

“The petitioner has challenged the DCI and DPP’s actions and it is just proper that conservatory orders be issued to halt the real and imminent threat of violation and infringement of the JamboPay rights and freedom pending hearing and determination of this petition,” read the court papers.

The director also argued that claims by the DPP and DCI that the company failed to supply and install the server at NHIF are “incorrect, untrue and calculated to mislead the public for undisclosed purposes.”

The court directed that the application be served upon the respondents within two days and that they appear for inter-party hearing on June 5, 2019.
