Company seeks Ksh. 2B compensation over govt ban on plastics

A manufacturer who claims to have lost business after the government ban on plastics came to effect has taken a notch higher a fight for compensation of Ksh.2 billion.

Hi-Plast company has filed an application in which it now wants the High Court to enter judgment against the government for failure to enter appearance for the compensation case.

“We pray that the court grants us leave since in spite of proof of service the defendants have  defaulted in entering appearance and has further failed to file any appropriate defence before this court,” advocate Eddy Orinda stated in court papers.

According to Orinda, the State actors including the National Environment Management Authority (NEMA) have  neglected or refused to act despite knowing that the matter is alive in court.

He maintained that to date the government has not entered appearance or filed papers in opposition of the suit in court, hence, the move by the company to seek authorization for judgement in default of the application.

In the matter, Hi-Plast company had earlier sought an order to quash the gazette notice by the Ministry of Environment, banning the manufacture and use of plastic bags.

The High Court delivered a judgement in a separate case filed by Kenya Association of manufactures(KAM) in which the company lost.

Hi-plast director, Mahesh Dodhia, in suit papers says the ban has caused him unimaginable losses, having invested heavily in machinery and raw materials as well as defaulted on loan repayments.

The case will be mentioned on July 2.
