Court bars Isiolo County Assembly from picking new Minority Leader

The High Court has barred the Isiolo County Assembly from electing a new Minority Leader pending the hearing of a suit filed by two MCAs who were ousted from the Assembly.

The two Members of County Assembly (MCAs) are Ali Dima Duba and Nura Diba Billa.

“The acts of the Respondents constitute an infringement on the right of the people of Isiolo County to be represented by their chosen representatives in the various forthcoming House sittings and hence it is greatly prejudicial to them,” the court ordered.

Justice Makau directed the matter be mentioned on November 6 for further directions.

The two MCAs  were thrown out of the chambers for trading barbs with the Speaker shortly after after the county legislators shot down the Punguza Mizigo bill on October 16, 2019.

The Speaker de-whipped Mr Dima from the position of minority leader and banned him and counterpart from taking part in any of the committees’ activities until the 28 days elapse.

They argue that the respondents arbitrarily, illegally, un-procedurally removed the Applicants from their respective positions and illegally suspended them from the House sittings.

The claims they were ejected without being accorded a right to be heard among others concerns.
