Court bars probe into Wavinya Ndeti’s lawyer over affidavits

High court judge Roselyn Aburili has barred the Director of Criminal Investigations and Director of Public Prosecutions from investigating a city lawyer Ham Lagat over an affidavit.

Lagat was on the receiving end for the role he played in the commissioning of an affidavit in the petition challenging the election of Machakos governor Alfred Mutua.

“For the avoidance of doubts, the respondent be restrained from taking further proceedings, sharing the results of any investigations or prosecuting the applicant before any forum until 24th of January this year,” ruled Aburili

Ham moved to the high court claiming that police stormed his home in Kileleshwa and thereafter threatened his family.

The matter will be mentioned on the 24th of this month.

Late last month Lawyer Ham Lagat told court that contrary to earlier claims, he is the one who commissioned Wavinya Ndeti’s affidavits.

Alfred Mutua, through his lawyer, told the court that Lagat did not commission the affidavits, a claim the latter refuted while being cross-examined by the governor’s legal team.

The lawyer said he did not write any letter to Mutua’s lawyer disowning the affidavits.
