Court blocks DPP from charging Jirongo

The High Court has barred the Director of Public Prosecutions (DPP), Keriako Tobiko, to charge former Lugari Member of Parliament, Cyrus Jirongo, with giving false information linking Jonathan Moi with a 50 million shilling land fraud.

Justice George Odunga, in his ruling, intimated it would be unjust and misuse of the court process to prosecute Jirongo over an alleged offence committed two decades ago.

Jirongo had last year in court linked the son of former President Daniel Arap Moi to Soy Developers Limited, which is at the centre of a dispute between him and businessman Sammy Boit Kogo.

In the case the politician claimed he bought the firm from Kogo in 1991, who then allegedly admitted he was a proxy of Jonathan Moi and that he paid 7 million shillings to acquire the firm in Upper Hill.

Jirongo seeks to bar his prosecution over the land on Elgon Road and accuses Kogo of using the DPP and CID to ensure he is convicted, after Tobiko in February last year approved he be charged with giving false information to police, forging land documents and illegally using the land to secure a loan.
