Court Cancels South Sudanese Rape Suspect Bail

Justice Luka Kimaru cancelled the bail, which had been issued a week ago by the Makadara Law Court on grounds that the case is a serious one adding that the Kenya and South Sudan have no extradition treaty which will make it impossible to issue bail.

Justice Kimaru has now directed that the case be heard and determined within three months. 

Last week, 30 year old Makoy Deer’s bail hearing was postponed after his lawyer failed to report to Makadara Court.

SIGN LANGUAGE

It is alleged that Mr. Deer allegedly raped the five year old girl on March 3rd at Embakasi.

Deer allegedly summoned the girl using sign language.

A neighbor reportedly saw him and urged the girl to tell her parents who notified the police.

Deer did not plead to the charge because he does not understand English or Kiswahili.

The prosecution had asked the Judge to deny Deer bond saying that he is a foreigner charged with a capital offence.
