Court clears Queens Counsel Qureshi to prosecute DCJ Mwilu

The High Court has ruled that British advocate Khawar Qureshi was properly appointed to appear in the proceedings against Deputy Chief Justice Philomena Mwilu.

In a ruling read by Justice Chacha Mwita, the five-judge bench said they were not persuaded that his appointment is a surrender of the Office of the Director of Public Prosecution.

“We are satisfied that his appointment meets the required law…With respect to all the challenges… We are constrained to find that the application is without merit….,” he said.

This means that Qureshi will continue to represent the DPP in the corruption case against DCJ Mwilu.

The five judges who issued the ruling are Justices Mwita, Helen Omondi, Mumbi Ngugi, Francis Tuiyot and William Musyoka.

They further dismissed an application seeking to bar Senators James Orengo and Okong’o Omogeni from representing DCJ Mwilu.

The two lawyers are to continue representing their client with the court ruling that the duo’s Parliamentary duties do not amount to conflict of interest.

Orengo and Omogeni sit in the Committee on Legal Affairs at the National Assembly.

“We’ve not seen evidence that the case was discussed in the sitting. The application has no merit,” the judges ruled.
