Court declines to hear appeal of man featured on CitizenTVs Prison Diaries

The Court of Appeal has thrown out the case of Julius Wambua, a Machakos man whose daughter confessed to being coached by the mother to lie about being defiled.

According to the judges, Wambua should continue serving his life sentence stating that he was rightfully tried and there was no miscarriage of justice.

In the ruling, the court claimed the witness, Wambua’s daughter, was of sound mind when she testified against her father, further ruling that no other witness contradicted the rape claims to cast shadow on the witness testimony.

This ruling comes after Dorcas Wambua, Wambua’s daughter, sensationally claimed that she was coached by her mother to accuse the father of raping her.

In an interview on Prison Diaries, a series by Citizen TV, Dorcas said that nine years later, she regrets a decision that has now pinned her father to a lifetime prison sentence.

For Dorcas, the father is serving a prison term wrongfully out of a coalition of convenience formed between herself and her mother.

The court however effectively slapped Wambua with the harsh reality of continuing with his life sentence for rape.

Wambua’s lawyers are now seeking a retrial of the case from Machakos Law Courts to introduce fresh evidence that will exonerate him from the rape allegations.

A confession by the daughter to be filed as the new evidence.

Dorcas who was in court during the ruling on Friday, continues to regret that her testimony was the one used to convict her father.
