Court delays Wambora appeal case as lawyer taken ill

The Nyeri Court of Appeal has adjourned the hearing of an appeal case filed by Embu Governor Martin Wambora challenging the High Court ruling that nullified his election.

The hearing which has been set for June 5, 2018 came after one of the lawyers representing Embu Deputy Governor David Kariuki failed to show up after falling ill.

An application filed by Lucy Mwai pleaded to have the case deferred to a later date as Ms. Wairimu Rungaita, who was representing David Kariuki, was scheduled to go for surgery.

Mwai, who was standing in for Wairimu, also indicated that she needed more time to familiarise herself with the case, an application that was not opposed by any of the counsels in court.

Judges hearing the case; Fatuma Sichale, Patrick Kiage and Sankale ole Kantai, allowed the application and ruled in Kariuki’s favour.

Governor Wambora moved to the Appeal Court to challenge the nullification of his victory by the High court on September 19, 2017 in a petition filed by former Embu Senator Lenny Kivuti.

Editor’s Note: An earlier version of this story had wrongfully indicated that Embu County has no Governor. Governor Martin Wambora remains in office until his appeal case is heard and determined. Should the Court of Appeal uphold the High Court decision and Wambora does not appeal at the Supreme Court, he would lose his seat and have to face off in a by-election.
