Court directs CJ Maraga to appoint judges for Ruaraka land case

The High Court on Tuesday directed that the Ruaraka land case be allocated an even number of judges to hear and determine the case filed by the National Land Commission.

While declining to give conservatory orders, the court further directed that the application be argued before the judges who will be appointed by Chief Justice David Maraga to hear and determine the issue.

Further, Environment Judge Bernard Eboso in his ruling, said that the legal issues in the Ruaraka matter justify the need to have a bench of an even number to hear and determine the case.

“It would be inappropriate to grant conservatory orders yet parties had agreed to have the matter be heard before the bench,” the court ruled.

The NLC is seeking to confirm the owner of the land on which Drive Inn Primary and Ruaraka Secondary schools in Nairobi stand.

The commission is also seeking orders to halt all criminal and civil proceedings against individuals accused of corruption regarding the land until the case is heard and determined.
