Court dismisses case challenging Ford People dissolution

 

The High Court has dismissed a case by a Ford People party official who was challenging the dissolution of the party.

High Court Judge Msagha Mbogholi instead directed the petitioner, Jerry Kenyasa, to exhaust the mechanisms placed under the party’s constitution to resolve the dispute arising from the dissolution of the party.

“The best that this court can do is to order parties in this case to submit themselves to the constitution of the party which establishes the internal dispute resolution mechanism under clause 8b,” the court ruled.

Judge Mbogholi said the court was unable to void the dissolution of the party as sought by the petitioner, adding that the dispute had not been subjected to the internal party dispute resolution.

Kenyasa had moved to the High Court after the Political Parties Dispute Tribunal, chaired by Kyalo Mbobu, dismissed the same applications on grounds that he did not exhaust internal party mechanisms in addressing the dispute.

According to Kenyasa, the move to dissolve the party had been made without consulting the party owners and founders.

Albert Nyaundi and Ford People were named as respondents in the case.
