Court dismisses petition against Governor Granton Samboja

The High Court in Voi has dismissed a petition challenging the election of Taita Taveta Governor Granton Samboja in the August 2017 election.

Judge Eric Ogolla on Monday dismissed the case saying the court has no jurisdiction to ascertain allegations that Governor Samboja used forged academic documents to vie for the seat.

Justice Ogolla said the Ethics and Anti-Corruption Commission is the body mandated to probe and ascertain such claims.

The Judge further noted that the petitioners failed to convince the court that Governor Samboja engaged in electoral malpractice during the August 8, 2017.

The Governor’s lawyer, Edwin Ayiro, expressed satisfaction with the judgment, saying that Mr. Samboja is now free to serve his county residents.

Following dismissal of the case, the petitioners – Arstrong Kiwoi na Thomas Njumwa – were directed to pay Ksh.500,000.
