Court fails to stop MPs from debating Ouko ouster motion

The High Court has declined to stop Parliament from debating a petition seeking to remove Auditor General, Edward Ouko, from office.

Instead, High Court Judge, Chacha Mwita, directed the petitioner, Okiya Omtata, to file and serve the respondents in the case and appear for inter-party hearing on March 6.

In the case activist Okiya Omtata moved to court seeking to shield Auditor General, Edward Ouko, from allegations of wasting public funds. He argues that Emanuel Mwagambo’s petition lacks merit.

Omtata further claims the allegations files against Ouko are being fueled by members of the Executive and the Legislature who want to get rid of Ouko.

The National Assembly, its Speaker, the Attorney General, Emmanuel Mwagambo Mwagonah have been named as respondents.

Edward Ouko, the Director of Public Prosecutions, the National Police Service, the Ethics and Anti-Corruption Commission and the Senate are listed as interested parties in the case.
