Court frees suspects in JKIA terror attack case

Four terror suspects accused of carrying out an attack at the Jomo Kenyatta International Airport, have been set free by a Nairobi court.

The four Somali nationals – Hassan Abdi Mohamud, Mohammed Osman Ali alias Modika, Ilyas Yusuf Warsame and Garad Hassan Fer Ali – were charged with various counts.

The four were charged with committing a terrorist act at a Java coffee house located at JKIA Unit One on January 16, 2014.

They were also charged with obtaining Kenyan registration by false pretense, and unlawfully being in the country in the said year.

They had also been charged with being in possession of 52 kg trinitroleune (TNT) explosives on January 18, 2014 at Shauri Moyo.

Alongside this, they were also accused of making false declarations to obtain Kenyan registration, as well as giving support to terror groups.

Chief Magistrate Roslyn Oganyo acquitted the four in all counts in the two cases on the basis that the evidence relied upon by the prosecution could not substantively link the accused persons with the crimes.

She further stated that throughout the four year case, prosecution witnesses were inconsistent in their testimony hence it could not fully be relied on to convict the accused persons.

The magistrate further dismissed an application by the prosecution through Duncan Ondimu to have the release order stayed to allow an appeal be effected.
