Court of Appeal to rule on Mother-in-Law actress Charitys case

The Court of Appeal will on Thursday, November 19 make a determination in a case of matrimonial property ownership spanning three decades.

In the case, Elizabeth Wanjiru, better known as Charity of Citizen Television’s local drama Mother-in-Law, who separated from her Ugandan husband in the 80’s, has claimed ownership of their matrimonial home unsuccessfully.

Her estranged husband, Shem Bageine, is the Ugandan Minister of State in East African Affairs.

He went back to his native Uganda in 1987 to build his career after his Kenyan citizenship was revoked by the government.

Bageine rose through the ranks from MP to assistant minister then to his current position as minister.

Ms Wanjiru says her estranged husband abandoned her in 1981 after 13 years of marriage.

Wanjiru argues that the house was bought by her money that she credited in an account she held jointly with Mr Bageine. However, Mr Bagaine registered the property under his name before allegedly selling it.

Ms Wanjiru has been in and out of court fighting for ownership of the home for the past 28 years. She wants the court to grant her full ownership arguing it is her savings that bought the house.

In 2003, the High Court under Justice Richard Kuloba ruled that Ms Wanjiru shouldn’t be thrown out of her home, but did not grant her ownership.

Mugo Muiru Investment Limited, a company that claimed to have bought the house from Wanjiru’s husband, contested the decision at the Court of Appeal in 2004.

Wanjiru, however, claims the company was non-existent at the time of the alleged transaction.

On Thursday, the respondents; Ms Wanjiru and her husband who haven’t met for 34 years will be expected to appear before the Court of Appeal alongside Mugo Muiru Investments Limited and Housing Finance Company, the developer of the property.
