Court of Appeal upholds Ugenya MP Chris Karans election nullification

It is back to the ballot in Ugenya after the Court of Appeal on Thursday upheld the High Court decision to nullify the election of Member of Parliament Chris Karan.

While delivering the ruling, Justice Hannah Okwengu stated that the elections were marred with malpractices.

Karan had filed the appeal after the High Court in Kisumu previously annulled his election saying the process was not free and fair.

In the March 1, 2018, ruling, Justice Triphisa Wanjiku Cherere further directed Karan to pay the petitioner David Ochieng and the Independent Electoral and Boundaries Commission (IEBC) Ksh.3.5 million each in costs.

Mr. Ochieng, who contested in the August elections on a Movement for Democracy and Growth (MDG) party garnered 23,418 votes against his challenger, ODM’s Chris Karan, who garnered 23,765 votes.

The legislator has since said he will move to the Supreme Court to challenge the Court’s decision.
