Court orders 3,800 teachers reinstated to TSC

The Employment and Labour Relations Court has ordered 3,800 teachers under the employment of the Public Service Commission (PSC) reinstated back to the Teachers Service Commission (TSC).

In the ruling, Justice Nelson Aboudha said that TSC is the only professional body to register and employ teachers.

Further, the Judge said that the TIVET authority has no powers to register and employ teachers adding that it can only register and train non-teachers.

Speaking after the ruling, KUPPET Secretary General Akello Misori welcomed the ruling saying that TIVET has no authority to employ teachers.

The ruling comes after the Kenya Union of Post Primary Education (Kuppet) moved to court to fight the plan to transfer over 3,780 teachers, tutors and lecturers in technical and vocational training institutions, who are employed by Teachers Service Commission, to the Public Service Board (PSB).

Those affected were teachers and tutors in national polytechnics, technical institutes and vocational institutes.
