Court orders arrest of Defence PS Kirimi Kaberia

Defense Principal Secretary, Kirimi Kaberia, is expected to appear in court on Monday, October 24 to explain why he has failed to pay five million shillings to a former senior army officer who was sacked unlawfully nine years ago.

This is after High Court Judge, George Odunga, issued a warrant of arrest against the PS directing the police to execute the arrest order.

“I hereby direct OCPD Central Police to arrest and bring the PS in court on the 24th of this month,” Justice Odunga ordered.

In the case, the former army officer, Silvanus Odiaga, argued the accounting officer in the Defense Ministry, has declined to comply with the orders issued in July 2014 to pay him for unlawful termination.

He was accused of incurring expenses in respect of tinned pineapples, cooking fat, bags of sugar, rice and Blue Band.

Although he was acquitted of some of the allegations, a committee that investigated him found him guilty of four allegations relating to flouting procurement regulations.

He appealed before the committee, but his plea was not considered. Eventually he was retired on pension in September of the same year.

Odianga sued the government arguing  that his termination was in breach of his terms and condition of service and was actuated by malice.

Justice Linet Ndolo of the Labour Court ruled that his superiors mishandled his case and she set aside the criminal proceedings.
