Court orders Nyeri County to compensate former CEC

The Nyeri County government will have to part with Ksh.4.5 million shillings to compensate a former County Executive Commissioner (CEC) whose docket was scrapped.

Cecilia Ndungu – who served as CEC for Culture, Gender and Social Development –was asking for Ksh.9.3 million shillings from the county government as compensation after she was fired and her docket scrapped prior to the expiry of her 5-year term.

On December 5 2014, the Industrial Court issued orders which were later upheld by the Court of Appeal to quash the decision by Governor Nderitu Gachagua to fire Ndung’u from office.

The court found that the removal of the CEC from office was unlawful, unfair and unjustified.

Ndung’u argued that she would lose salaries, allowances and gratuities that she would have otherwise received – moneys that she was contractually entitled to until August 2017.

The court also awarded Cecilia Ksh.1 million as gratuity for the term she served before her dismissal.

Justice Ongaya ruled that the Nyeri County should pay her Ksh.3.4 million, which is the total amount she would have earned during her time of service where she was receiving Ksh.285, 000 each month for 12 months.
