Court overturns CS Kiunjuris decision to suspend NGO boss

The High Court has overturned a decision by Devolution Cabinet Secretary Mwangi Kiunjuri to suspend NGO Coordinating Board Executive Director Fazul Mohamed.

In his ruling, Judge George Odunga further directed the petitioner, Fazul Mohamed, and the board to serve the petition to the respondents.

Fazul moved to court to challenge the decision by Kiunjuri, saying that the CS breached the constitution, specifically section 7(3) of the state Corporation Act.

He argues that the powers to issue directions and remove members of the NGO board from office are solemnly reserved for the president and not the CS.

“The decision to send Fazul on compulsory leave is illegal, unlawful and null in void,” the petitioners argued.

The petitioners argued that CS Kiunjuri acted in bad faith by making unilateral decision.

The CS dissolved the board last Wednesday and sent the Executive Director on forced leave.

Consequently, Ali Yusuf was appointed as the acting Executive Director over allegations that Fazul held a fake degree.

Kiunjuri’s actions came just a day after a foreign national, working for an international aid agency, filed a petition at the Ethics and Anti-Corruption Commission (EACC) accusing him of corruption.

Delphine Bram Christopher is accusing Kiunjuri of allegedly soliciting for Ksh20 million from a group of non-governmental organisations to effect a less punitive law governing the civil society groups.
